Brazil’s Supreme Court ruled that homophobic insults can be punishable by prison time, according to WION.

Members of the Brazilian Supreme Court ruled that homophobic slurs will now result in a prison sentence.

The decision was made during a hearing on August 22, marking a triumph for the LGBTQ+ community.

Brazil is one of the South American countries that has tirelessly fought against homophobia and hate crimes.

Protection for all

This historic decision places anti-LGBTQ hate speech on the same level as racist hate speech, according to VICE.

The Chief Justice stated that his ruling was a «constitutional imperative» to provide LGBTQ citizens with legal protection.

In 2019, homophobia was made a crime in Brazil, but only if it was directed against the LGBTQ community in general.

This new ruling clearly states that any act of homophobia against individuals will also be charged as a crime.

Activists celebrate Brazil’s decision

The Brazilian Association of Lesbians, Gays, Bisexuals, Transvestites, Transgender, and Intersex (ABGLT) celebrated the decision.

«The Federal Supreme Court (STF) ruled, by 9 votes to 1, to allow recognition of acts of homophobia and transphobia as a crime of racial injury.»

«The action was analyzed by the Supreme Court through a virtual plenary.»

«This is a historic achievement for our community,» ABGLT stated on their official Facebook account.

Alarming murder rate in the LGBTQ community

Brazil has one of the highest murder rates of LGBTQ individuals in the world, according to a study by Grupo Gay da Bahia.

In 2022, more than 242 violent deaths of LGBTQ people were reported.

The South American country is also considered the deadliest in the world for transgender people, according to VICE.

According to Transgender Europe statistics, 1,741 transgender individuals have been murdered between 2008 and 2022 in Brazil.

Brazilians turned to social media to celebrate the Supreme Court’s decision in favor of the LGBTQ Community.

«We need to celebrate, yes! It’s a victory against LGBTphobia,» said a Twitter user.

«I lived to see this decision. The movement continues,» another person posted.

«An important achievement, but a sign of how backward Brazil still is,» said another activist celebrating the accomplishment.
